These Terms and Conditions govern the provision of services by Alba Air ("we", "us", "our") to the client ("you", "your").

By booking or using our services, you agree to these Terms and Conditions.

1. Services

Alba Air provides drone photography, videography, aerial inspections, surveying, mapping, and related aerial imaging services throughout Scotland and the United Kingdom.

All services are subject to applicable aviation regulations, weather conditions, site suitability, and operational safety requirements.

2. Business and Consumer Clients

Unless otherwise agreed, our services are provided on a business-to-business basis.

Where the client is acting as a consumer, nothing in these Terms shall affect any statutory rights available under applicable consumer protection legislation.

3. Quotations

All quotations are valid for 30 days unless otherwise stated.

Quotes are based on the information provided at the time of enquiry. Additional work, travel, editing, data processing, site visits, or client-requested changes not included within the original quotation may incur additional charges.

4. Bookings

A booking is confirmed once accepted in writing by both parties.

We reserve the right to request a deposit before work commences.

Dates and times are subject to availability.

5. Payment Terms

Invoices are payable within 14 days of issue unless otherwise agreed in writing.

Late payments may incur interest and recovery costs in accordance with applicable UK legislation.

Final deliverables may be withheld until full payment has been received.

6. Weather and Flight Restrictions

Drone operations are subject to weather conditions, airspace restrictions, and aviation regulations.

If weather conditions, airspace restrictions, safety concerns, equipment failure, or circumstances beyond our control prevent safe flight operations, we may:

  • Reschedule the work at a mutually convenient time; or

  • Cancel the operation if no suitable alternative is available.

We shall not be liable for delays caused by circumstances outside our reasonable control.

7. Client Responsibilities

The client agrees to:

  • Provide accurate project information;

  • Obtain any permissions required from property owners or landowners;

  • Ensure safe and legal access to the site where necessary;

  • Notify us of any hazards, restrictions, or site-specific risks;

  • Ensure they have authority to instruct work at the relevant location.

The client is responsible for ensuring they have the legal right to request services at the specified site or property.

8. Accuracy of Information

Alba Air relies upon information provided by the client when preparing quotations, flight plans, risk assessments, and project deliverables.

We shall not be responsible for delays, additional costs, or inability to perform services arising from inaccurate, incomplete, or misleading information supplied by the client.

9. Site Access and Conditions

The client is responsible for ensuring that reasonable access to the site is available on the agreed date and time.

Where access is restricted, delayed, prevented, or significantly altered from the information originally provided, resulting in additional travel, waiting time, or repeat visits, additional charges may apply.

10. Regulatory Compliance

All drone operations are conducted in accordance with applicable regulations issued by the United Kingdom Civil Aviation Authority (CAA).

We reserve the right to refuse, postpone, modify, or cancel any operation that cannot be conducted safely or legally.

11. Privacy and Site Permissions

Alba Air will conduct operations in accordance with applicable privacy and data protection legislation.

The client is responsible for ensuring that any necessary permissions, notifications, consents, or authorisations relating to the property or location have been obtained where required.

12. Deliverables

Deliverables may include photographs, video footage, inspection imagery, reports, maps, models, survey outputs, or other agreed project materials.

Delivery times are estimates and may vary depending on project complexity and operational requirements.

13. Client Review and Revisions

Where edited photographs, videos, reports, maps, or other deliverables are provided, the client shall review the deliverables within 14 days of delivery.

Unless otherwise agreed, one round of minor revisions is included within the quoted price.

Additional revisions, alterations, or changes requested after approval may be subject to additional charges.

If no feedback is received within 14 days of delivery, the deliverables shall be deemed accepted.

14. Raw Footage and Raw Data

Unless specifically agreed in writing, Alba Air is under no obligation to provide raw photographs, raw video footage, survey source files, project files, or unprocessed data.

Where raw files are requested and supplied, additional charges may apply.

15. Intellectual Property

Copyright and all intellectual property rights in photographs, videos, survey outputs, maps, reports, models, and other materials created by Alba Air remain vested in Alba Air unless otherwise agreed in writing.

Upon receipt of full payment, the client is granted a non-exclusive, non-transferable licence to use the deliverables for the agreed purpose.

The client may not resell, sublicense, commercially redistribute, or exploit deliverables beyond their agreed purpose unless expressly agreed in writing.

16. Use of Project Materials

Unless otherwise agreed in writing, Alba Air reserves the right to use photographs, videos, and other project materials for portfolio, website, marketing, promotional, competition, and social media purposes.

If confidentiality is required, this must be agreed before the project begins.

17. Inspection and Survey Information

Inspection reports, survey data, maps, measurements, models, and imagery are provided for informational purposes only.

Clients should not rely solely upon drone data when making structural, engineering, legal, surveying, safety-critical, regulatory, or financial decisions.

Where specialist advice is required, appropriately qualified professionals should be consulted.

18. Survey Accuracy

Survey data, maps, measurements, models, and imagery are generated using industry-standard equipment and methods. However, all outputs are subject to operational limitations, environmental conditions, GPS accuracy, satellite availability, processing methods, and site-specific factors.

Unless expressly agreed in writing, Alba Air does not warrant that any survey output is suitable for legal boundary determination, engineering design, planning applications, regulated surveying work, or other professional purposes.

Alba Air is not a chartered surveying practice unless expressly stated in writing.

Deliverables are not intended to replace professional surveying, engineering, architectural, legal, or other regulated professional advice.

19. Regulatory and Third-Party Acceptance

Where deliverables are intended to support planning applications, regulatory submissions, insurance matters, grant applications, legal proceedings, or other third-party processes, Alba Air makes no guarantee that any authority, regulator, insurer, court, lender, or third party will accept or approve such materials.

20. Travel and Additional Expenses

Unless otherwise stated within the quotation, travel expenses, accommodation, parking charges, ferry costs, permits, access fees, or other project-related expenses may be charged separately where applicable.

Any such charges will be communicated to the client in advance where reasonably possible.

21. Data Retention

Unless otherwise agreed in writing, Alba Air may delete project files, raw footage, photographs, survey datasets, and other project materials 90 days after final delivery.

Alba Air shall not be responsible for retaining project files indefinitely.

22. Insurance

Alba Air maintains appropriate public liability and aviation insurance for the services provided.

Evidence of insurance may be provided upon reasonable request.

23. Subcontracting

We reserve the right to engage suitably qualified subcontractors or drone operators where necessary to fulfil a project.

Where subcontractors are used, Alba Air remains responsible for the overall delivery of the agreed services.

24. Limitation of Liability

To the fullest extent permitted by law, Alba Air's total liability arising from any claim relating to the services shall not exceed the total amount paid by the client for the relevant services.

We shall not be liable for any indirect, consequential, incidental, special, or economic losses, including loss of profit, loss of revenue, loss of business, loss of opportunity, loss of contracts, loss of anticipated savings, or loss of goodwill.

Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any liability that cannot legally be excluded or limited.

25. Cancellation

The client may cancel a booking by providing written notice.

Unless otherwise agreed:

  • More than 7 days before the scheduled work: no cancellation charge.

  • Between 48 hours and 7 days before the scheduled work: up to 50% of the quoted fee may be payable.

  • Less than 48 hours before the scheduled work: up to 100% of the quoted fee may be payable.

Any deposit paid may be non-refundable unless otherwise agreed in writing.

Where significant preparation, travel, permissions, planning, or operational work has already been undertaken, reasonable costs may be charged.

Should a project be postponed rather than cancelled, any payments already made may be transferred to the rescheduled booking at our discretion.

Where Alba Air is able to rebook the cancelled time slot, cancellation charges may be reduced at our discretion.

We reserve the right to reduce or waive cancellation charges at our sole discretion.

26. Data Protection

We process personal data in accordance with our Privacy Policy.

A copy of our Privacy Policy is available on our website.

27. Force Majeure

We shall not be liable for any failure or delay in performing our obligations where such failure or delay results from circumstances beyond our reasonable control, including but not limited to severe weather, natural disasters, government restrictions, equipment failure, airspace restrictions, telecommunications outages, industrial action, public emergencies, acts of terrorism, or civil unrest.

28. Complaints

If you are dissatisfied with any aspect of our services, please contact us as soon as possible so that we may attempt to resolve the matter promptly and professionally.

29. Severability

If any provision of these Terms is found to be unlawful, invalid, or unenforceable, the remaining provisions shall remain in full force and effect.

30. Entire Agreement

These Terms, together with any quotation, proposal, statement of work, or written agreement issued by Alba Air, constitute the entire agreement between the parties and supersede any prior discussions, negotiations, representations, or understandings relating to the services.

31. Amendments

Alba Air reserves the right to update these Terms and Conditions from time to time.

The version in force at the date of booking shall apply to the relevant project.

32. Governing Law

These Terms and Conditions shall be governed by and interpreted in accordance with the laws of Scotland.

Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the Scottish courts.
